By accessing and using our services, you accept and agree to be bound by the terms and provisions of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Website Purpose: Signal Menu provides a digital menu and no-ordering solution for registered Store Owners, enabling their customers to display and navigate a digital Menu using their smart phones. At the same time, it provides partners with the opportunity to become a Signal Menu affiliate. 1.3. Validity of Terms: At its own discretion and without liability, Signal Menu can terminate these Terms of Use and all services at any time and with immediate effect. However, Signal Menu will announce such measures through a notification on the Website, email, or direct contact. 1.4. Amendments: Signal Menu reserves the right to ask you to acknowledge an amended version of these Terms of Use. 1.5. Personal Data: Personal data will be collected and processed in connection with the Service in line with our Privacy Policy. 1.6. Intellectual Property: This Website and its original content, features, and functionality are owned by Signal Menu and are protected by international intellectual property laws. 1.7. Trademarks: Apart from the registered trademark of Signal Menu, all other trademarks displayed on the Website are registered trademarks of third parties. No trademark can be used without the written permission of its owner.

2.1. Store customers (simple users) can access directly the menu of a registered Store (restaurant, café-bar, takeaway, hotel, etc.) and navigate through directly by scanning a QR code with their smart phones. 2.2. Store Owners can choose between four modes upon registration: free trial, typical business trial, enterprise trial, and affiliates account. All modes have limitations depending on the number of stores, tables, and daily views. It is the Store Owners' responsibility to choose the mode that applies best. 2.3. Signal Menu creates a dedicated website for each registered Store upon registration (e.g. https://app.signalmenu.com/demo). 2.4. Store Owners are responsible for building and managing their store catalogue, product price list, and keeping it updated. 2.5. Signal Menu itself does not provide any food or drink or run any of the registered Stores, and bears no responsibility for their products. 2.6. Customers are not obliged to use the platform and can access the MENU through WEB. 2.7. All services provided to customers by the registered Stores are not a part of these Terms. Store Owners are solely responsible for menu content and management. 2.8. This service is provided to customers free of charge. Signal Menu is not responsible for additional requirements from Store Owners. 2.9. Signal Menu has no responsibility for the use of logos, images, or texts made in the catalogs by Store Owners.

3.1. Affiliates and Store Owners may create their own user account upon registration. You must be at least 18 years of age to use the Service and create an account. 3.2. You guarantee that the information you provide is correct, complete, and up to date. You must keep your information accurate at all times. 3.3. You are responsible for all activity on your user account and must keep your username and password secure at all times. 3.4. For security reasons, you will not permit or enable third parties to use your account. 3.5. Signal Menu is entitled to verify the information you have provided at any time and to refuse account creation without reason. 3.6. You may delete your account manually. Upon deletion, Signal Menu will delete all your data permanently. 3.7. Signal Menu reserves the right to delete or deactivate your account at any time if it deems you are violating any of the terms.

4.1. You will comply with all relevant legislation, and you will use the Website/Application only for legal purposes. 4.2. You will not use the Website/Application to cause annoyance, disruption, or inconvenience. 4.3. You will not attempt to harm in any way the Website/Application. 4.4. You will use authorized devices, compatible hardware, updated software, and secure network connections.

5.1. Affiliates are entitled to vouchers. Each voucher value is split between a one-time subscription discount for the business and a commission to yourself. 5.2. Vouchers are equal to the displayed percentage of subscription values and can be used more than once. 5.3. You are entitled to commission only if the registered business does not request a refund within 15 days of subscription payment. 5.4. Payments are processed monthly once a minimum threshold of 90 EUR or 90 USD is reached. 5.5. Signal Menu may terminate the partnership, cancel, or suspend your account at any time.

6.1. Signal Menu grants you a limited, non-exclusive, revocable, and non-transferable licence to access and use our Platform. 6.2. All rights to the Website/Service are and will remain the property of Signal Menu. 6.3. The Website/Application can be used in connection with third-party services. Signal Menu is not liable for third-party goods, services, or content.

7.1. You undertake to indemnify Signal Menu against all claims, costs, damage, losses, and liability claims resulting from or in connection with a violation of any provision of these Terms of Use.

8.1. These Terms of Use are subject to Dutch law. The place of exclusive jurisdiction for all disputes arising from or in connection with these Terms of Use is the United Kingdom.

9.1. Merchant of Record: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. 9.2. Pricing Adjustments: Signal Menu may modify package prices with prior notification. 9.3. 14-Day Money-Back Guarantee: We provide a 14-day unconditional money-back guarantee on all subscription plans. If you are not satisfied for any reason within 14 days of purchase or renewal, you may request a 100% full refund. 9.4. Refund Requests & Cancellation: Refunds can be requested by emailing [email protected], clicking the Refund button on the Subscription page in your dashboard, or through Paddle at https://paddle.net. When a refund is processed, subscription access terminates immediately. 9.5. Payout Method: Approved refunds are returned to the original payment method within 5 to 10 business days.
